Continued on Page A34 Continued from Page A32 Hold Harmless Issues As much as we want everything to go right, sometimes it just goes wrong. A livestream of a funeral that doesn’t work because there is no connection to cell service or WIFI service may seem excusable to you - but it may seem like negligence to the family. While you may think you are simply trying to help a family by offering these services, in fact you are extending your services that they are now relying on to com- plete the funeral. When it goes wrong, this means they will not only be upset; it means they may have a reason to ask for a refund…or worse. (The worse is a lawsuit, in case you were trying to solve the last sentence.) There will be things out of your con- trol, and that is ok, so long as you dis- close it to the family. Consider language that identifies that your business is not: responsible if there are issues with the platform, with recording, or transmit- ting; no responsibility if the video is placed on other sites; no responsibili- ty if others that are recorded have an issue with the video; and no responsi- bility for using any materials they pro- vide for the video (no this does not pre- vent copyright issues from happening, but may provide you recourse if there is an issue using something they pro- vide). Consider issues that are relevant to your situation and include these in your broadcasting release. Production Checklist Issue Unfortunately, broadcasting funerals have hit the market at 100 mph and we are moving forward hoping it all works. In fact, many providers are simply winging the funeral production process and quite often letting the younger em- ployees handle it (because the young- er ones are always the most tech-savvy). This plan will not work long-term. Your business needs one final piece for your funeral production - and that is a checklist. It should include every- thing it will take to broadcast a funeral.
