Be aware that there are groups that scour the inter- net looking at images and videos for their property (ok - it’s not actually people. But there are algorithms that can crawl through sites looking through images and videos to find property that is copyrighted.) And once something is found that you have used without permission, it is an automatic violation, meaning the owner will be able to get monies from you for unau- thorized use. The workaround is simple. Get permission for any images or writings that you use. Consent and Disclosure Issues Many people do not think about getting permission to film because if the family is asking for it to be re- corded, then it must be ok. However, there are some other concerns to consider. First, make sure that ev- eryone who may be filmed and recorded is aware and accepts the terms. Does this mean that you get every- one at a funeral or cemetery to sign a release? No. But it does mean that you should post a sign and/or at least announce prior to recording that the funeral ser- vices will be recorded or live-streamed and if you do not wish to be included, they should stay away from, at which point you can identify a filming area and a safe non-filming area. Another thing to consider is making sure certain items are disclosed and agreed upon by the family when they approve of the video being broadcasted and/or recorded. In fact, those terms should be made clear to the family in setting up the event.
